Terms of Service
1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and ERH Studios ("we," "us" or "our"), concerning your access to and use of our website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
2. Intellectual Property & Code Ownership
We believe that when you pay for a website, you should own it. Upon full payment for our web design and development services, you (the client) are granted 100% full ownership rights to the final website, including all source code, databases, original custom design assets, and graphics created specifically for your project. You are free to host, modify, or transfer the site wherever you choose. ERH Studios retains the right to display the final work in our portfolio, but the actual deliverable belongs entirely to you.
3. Client Responsibilities
For custom web development and social media management services, you agree to provide timely feedback, assets, and necessary access to complete the project successfully. Delays in client feedback or missing materials may result in naturally extended delivery timelines across any 7-business-day quotes.
4. Payments and Refunds
Pricing for our services (Starter Website, Bundles, Social Media Management) is outlined in our proposals or on our pricing capabilities pages. Social media management is billed on a recurring month-to-month basis and can be canceled at any time devoid of long-term contract constraints. Due to the custom, unrecoverable manual labor of our digital services, refunds are generally not provided once work has materially commenced, except as required by law.
5. Hosting and Deployment
Website hosting is not included in the one-time build fee. We offer professional hosting for a fee of $100/year. Alternatively, you may choose to host the website yourself on your own platform (e.g., Cloudflare, Netlify, Vercel). If you choose to host yourself, we will provide assistance during the initial launch to ensure your site is live and functional. Note that self-hosted sites are the sole responsibility of the client for ongoing maintenance and server-related issues.
6. SEO and Search Rankings
While we use industry-standard best practices for Local SEO, we cannot guarantee specific search engine rankings or results. Search algorithms are controlled by third parties (like Google) and are subject to change. We build your site with the best possible foundation for success, but final rankings depend on many external factors, including local competition and ongoing content strategy.
7. Accessibility Compliance
Your website is delivered meeting WCAG AA accessibility standards to the best of our knowledge at the time of launch. This protects your business and ensures a great experience for all users. However, ERH Studios is not responsible for any accessibility violations introduced by the client after the final hand-off (e.g., uploading images without alt text, changing brand colors to low-contrast combinations, or modifying the layout). It is the client's responsibility to maintain these standards during ongoing use.
8. Modifications and Interruptions
We cannot guarantee the website will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance resulting in interruptions, delays, or errors.
